The Community of Madrid has become a popular prosecution for the first time in a forest fire case, the one recorded in Lozoyuela on July 16. The detainee remains in provisional custody without bail.
The Community of Madrid has taken a historic step in defending its natural heritage by formalising its role as a popular prosecution in the case opened for the forest fire in Lozoyuela, which occurred on July 16. This was confirmed by the Minister of Presidency, Justice and Local Administration, Miguel Ángel García Martín, during an event held in Prádena del Rincón.
This is the first time that the regional government has exercised this power, enabled by the Law 1/2026, of April 15, approved by the Assembly of Madrid and in force since last month. The law allows the regional government to intervene in criminal proceedings for crimes of arson and against natural resources and the environment that are of particular seriousness or pose a risk to individuals.
In the context of this case, the court has decreed provisional custody without bail for the detainee, who is being investigated for an alleged crime of forest arson. The precautionary measure responds to the risk to the life or physical integrity of individuals, as well as the risk of flight, reoffending, and the seriousness of the alleged crime, according to judicial sources.
With this intervention, the Community of Madrid reinforces its role in the protection of the mountains and natural spaces of the region. The regional government has announced that it will continue to collaborate with judicial authorities to clarify the facts and establish responsibilities.
Furthermore, the regional legal services are already studying their intervention in the proceedings opened for the fires in Burgohondo and Almorox, which were recently recorded in the Sierra Oeste. This new legal tool is presented as a key instrument for the active defence of the natural environment of Madrid and the safety of its citizens.
